RETAIL TERMS & CONDITIONS
We aim to supply good quality items from recognised manufacturers, fun for both children and adults. We are continually expanding the site, always endeavouring to provide higher quality and wider choice. When we cut costs on bulk stock purchases, we pass the savings on to the consumer by lowering prices.
1. ACCEPTED PAYMENT - Paying online is safe and simple, we accept Mastercard, Visa and Switch debit cards via our integrated PayPal shopping cart system. If you would like to create a completely free PayPal account to enable you to purchase from our website then please follow this link https://www.paypal.com. We authorise all credit card orders in 'real-time' and an email will be sent to you detailing your order. All goods remain the property of Madgadgets until full payment is received.
1.1 AUTOMATICALLY CANCELLED ORDERS - Orders we feel to be suspicious will be cancelled upon receipt. Fraudulent orders are always reported to the Police. Should we receive a chargeback from our Payment Solution Provider after the goods have been delivered we will assume that we have been defrauded. All details entered on the order form together with your IP address will be forwarded to the Police, which has so far resulted in a 100% conviction rate. The IP address used in relation to the fraudulent transaction will also be blacklisted from ordering at Madgadgets and several hundred other associated on-line retailers in the future. The above measures are to protect ourselves and our genuine customers against the high levels of internet fraud.
1.2 ORDERS CANCELLED DUE TO TECHNICAL ERRORS - There can be instances where the Website may encounter technical errors with wrong updates on quantity levels and/or prices. Any such problems will be intimated to the customers within 48 hours. MADGADGETS reserves the rights to refund the payments received for any such products for which the information on Quantity levels or Price has been wrongly reflected on the Website owing to technical errors.
2. WORKING HOURS / DESPATCH TIMES - Monday to Friday - 9am to 5pm. Saturday - 9am to 1pm. On occasion, certain products may be out of stock - on these rare occasions we will contact you via email as soon as possible to discuss how you choose to progress the order. This includes orders placed containing multiple items where one item is out of stock.
3. DELIVERY - All items displays the correct delivery charge provided the delivery address is within mainland UK. Orders to N.I. and offshore Islands may incur additional shipping charges.
UK Delivery times can vary per item between approx 3-5 days for items under 10kgs or 7-10 days on larger items - see item descriptions for details. The delivery cannot be tracked until past the maximum due date or a missed delivery card has been received. 'Custom Made' or 'Made to Order' items may occasionally take longer. Items under 10kgs and small parcels will generally ship via Royal Mail 1st Class or 48hr Parcel Force. Larger items are shipped by various Direct courier delivery services.
NOTE: We no longer dropship to any address outside of the mainland UK. If we receive any dropship order for an international delivery address, the order will be cancelled and the payment refunded.
3.1 UNDELIVERED / LOST GOODS - If after 28 working days (UK) from the date your order was dispatched (this excludes Saturday, Sunday & Bank Holidays) your good/s are still undelivered please follow the following procedure: Firstly, contact your local Royal Mail sorting office. In 95% of cases an attempt has been made to deliver the good/s. If no one was present to sign for the delivery they will have been returned to the postal sorting office / depot where they are stored for a period of 5 - 10 days. If after this period of time the good/s have still not been collected they
will be either destroyed by Royal Mail or returned to us at their discretion (returned post can take up to 5 weeks). If the good/s have been returned to us please refer to the section further down this page. If the good/s are not at your local sorting office / depot please contact us to inform that your good/s have not arrived. Please also include reference to your order number and the date that the item/s were ordered.
3.2 GOOD/S RETURNED TO US BY ROYAL MAIL / COURIER COMPANY - If after a period of time good/s are returned to us by Royal Mail or a courier company as either undelivered, uncollected, unknown address, refused or for any other similar reason they will be stored by us for a maximum of 1 month. If within this 1 month period you wish for the order to be resent, all re-postage charges which will be equal to the original postage charge. If we receive no contact from you within the first month then the goods will either be taken back into stock or destroyed.
3.3 FAULTY GOODS - If in the unlikely event you receive a faulty product or the product develops a fault within a reasonable period of time please return it for replacement (or refund if within 7 days as per the Distance Selling Regulations 2000). Please send an email to customerservices@madgadgets.com with the details of the fault / reason for returning the goods, your order number and your full address to which the item was delivered, and we can advise you of the correct address to post your faulty product. All faulty goods must be received/returned to Madgadgets within 14 days of notification of the fault, and receipt of the return address, if a replacment product is required. Any item returned as faulty outside of this period will be reviewed on an item by item basis and may not be considered acceptable for the issue of a replacement item. We will compensate your return shipping costs to us, only once we have established that the good/s were indeed faulty, although we cannot currently accept returns on worn clothing or footwear. If however, after the good/s being tested by ourselves, are found to be fully functional they will only be returned to you, once you have accepted to pay re-postage charges which will be equal to the original postage charge. Refunds will be made within 5 days from the date the goods are received once returned. Replacements are dispatched generally within 3-5 working days (Some items may take longer). Faulty goods must also be returned in the same aesthetical condition that they were supplied. If any returned good/s are aesthetically damaged they will be returned to you, and you will incur re-postage charges which will be equal to the original postage charge.
4. NO QUIBBLE GUARANTEE - Please do your best to make sure the items you order are the items you require to avoid unnecessary complications and expenses on return. We will accept returns within 5 working days, minus our carriage costs provided they are undamaged and suitable for resale. All items retuned to stock are subject to a 20% restocking fee. We regretfully cannot compensate your return shipping costs to us, or returns on clothing or footwear. This does not affect your statutory rights.
4.1 IMPORTANT NOTE: Upon delivery please physically open the box / package and check the product/s for damage during transit before you sign to accept it. If it has been damaged please refuse to accept it and ask for it to be returned to the senders address. Once returned to us we will then replace the damaged item by return. By signing for the product without checking it you are accepting that you have received the product/s in good condition.
5. PRIVACY POLICY - We only collect information when you order an item from the site, enter a competition or subscribe to our mailing list. In these cases you will be asked to complete some or all of your personal details, credit card details and delivery details. These details are passed to our accounts system via a secure server and are not available to any other parties other than our Payment Solution Provider - PayPal, who will not use your details for any reason other than for processing your order. All information is collected lawfully and in accordance with the Data Protection Act 1998.
6. COMPLAINTS - Should you have any complaint regarding this site, the services offered, or given, please email and we will respond in detail within 3 working days during which time we may need to contact you. Please title your email 'COMPLAINTS' in capitals. You will be kept well informed at all times.
7. SITE CONTENT - We try to keep product details up to date at all times. However, due to our wide range of suppliers, product aesthetics / specifications may vary from those show within this site. All images and text are the copyright of Madgadgets and cannot be downloaded, used, copied or reproduced in any way without our prior consent.

ADDITIONAL DROPSHIPPING TERMS & CONDITIONS
D1. DELIVERY TIMES - Orders placed by our ‘Dropshippers’ will normally be dispatched within 1-3 working days, but please also note the shipping / delivery time spans in our ‘RETAIL TERMS & CONDITIONS’ (‘Section 3') above as these will also apply from the day of despatch.
D2. DELIVERY TRACKING - We do not offer any delivery tracking facility to our dropshippers once an order has been placed, and information regarding the estimated day/time of delivery will need to be advised by the dropshipper to their customers based on the information contained within either the product descriptions (if applicable) or ('Section 3') of our RETAIL TERMS & CONDITIONS above. Only after 28 working days (UK) will a delivery be deemed non-delivered, missing or lost in transit and only after this period, will the information contained within RETAIL TERMS & CONDITIONS
('Section 3.1) apply.
D3. DROPSHIP RETURNS (DR) - Please do your best to make sure the items you order for your customers are the items they require to avoid unnecessary complications and expenses on return. If your customer wishes to return a product either due to being incorrectly supplied by Madgadgets or having received faulty goods please follow the example above given in ‘RETAIL TERMS & CONDITIONS’ (‘Section 3.2/3.3'). Please note all returns should arrive back with us within 5 working days from date of receipt. Please also note ('Section 4.1') as if your customer signs for the product/s upon delivery, they are effectively accepting the product/s in good condition, and we will therefore not entertain any returns/refunds regarding these items. We strongly advise all our dropshippers to inform their customers properly regarding ('Section 4.1'). Our full 'RETAIL TERMS & CONDITIONS' should be noted with respect to all returned goods, including all carriage costs which are to be incurred by either yourself or your customers, until such a time as we can prove the items were faulty, and we will only then compensate your/their shipping costs etc
D4. DROPSHIPPING ACCOUNTS - The initial one-off 'Account Creation' payment of £9.99 is non-refundable as it is payment towards the administration Madgadgets incurs each time a new account is created, and it also covers our licensing costs in relation to the free ebooks we provide to each new member. Once these ebooks have been received by any new member, we are unable to refund the associated membership fee as part of this fee goes towards the licensing costs associated with the distribution of the aforementioned ebooks. We reserve the right to refuse the creation of a dropshipping account at anytime, without explanation. We also reserve the right to terminate any existing dropshippers account without notice, if we feel that the dropshipper is not observing our company policies at all times or displaying behaviour that we feel to be unsuitable, has potential to bring Madgadgets reputation into disrepute. We also reserve the right to suspend or terminate any account that has remained inactive for a continuous period of 6 Months, and any Dropshipper wishing to have their account re-enabled, will be required to pay the re-activation fee of £4.99.
D5. DROPSHIPPERS DISCOUNTS - We will not enter into any negotiations with any individual Dropshipper or collective groups of Dropshippers regarding their level of discount or the methods we employ to calculate discount levels, and should we receive overly repetitive or aggressive communications regarding this topic from any Dropshippers, we will terminate their account without hesitation or notice, as detailed in ('Section D4') above.
D6. STOCK LEVELS - We always try to ensure that any item displayed on the website is immediately available for delivery. Unfortunately due to the nature of the online ecommerce business, we are not able to guarantee that an item will be available when a Dropshipper places their order. We are sometimes unable to update our website quickly enough during the course of the day, and occasionally after making a large number of RETAIL sales, one or two items may become unavailable, even though they appear in stock on the website. If this situation arises, we will always contact the Dropshipper and offer them the option of awaiting further stock to arrive to complete the order (and advise on an ETA of new stock) or cancel the order and immediately refund any payment via the PayPal refund process.
D7. CHANGES TO PRODUCT LINES / PRODUCT REPLACEMENTS - Due to the high number of suppliers and manufacturers we utilise to offer our wide range of diverse RETAIL and DROPSHIP products, we occasionally come across a situation, where we will be in transition from one supplier/manufacturer to another supplier/manufacturer. When this occurs we may have no other option than to remove certain product/s or product lines without prior notice, or mark them as 'Out of Stock' to provide an advance warning that they will no longer be available. If you notice this happening on the website, then please be patient, as it usually means we are about to replace old stock with new stock which always enhances the ability of the Dropshipper to sell more products. We obviously try to limit this occurring anymore than absolutely necessary, as we understand the complications it can cause our Dropshippers.
D8. 'INITIAL DROPSHIP ORDER VALUE LIMIT' - Each new account holder is subject to a first order value limit of £100.00 (not including delivery charges), until such a time when a successfully completed Dropship order has been processed and payment has been received. You will be notified of this stipulation when you create your new account. Once the dropshipper has completed their first dropship order, this order value restriction will be removed. Upon receiving an order for a value greater than £100.00, we will immediately notify the Dropshipper and refund their payment via PayPal. This is not subject to negotiation and will be enforced without exception.
D9. DISCLAIMER - Subject to the maximum extent permitted by law, Madgadgets excludes liability for any loss or damage of any kind howsoever arising, including without limitation any direct, indirect or consequential loss whether or not such arises out of any problem you notify to Madgadgets and Madgadgets shall have no liability to pay any money by way of compensation, including without limitation all liability in relation to any incorrect or inaccurate information on Madgadgets; any interruptions to or delays in updating Madgadgets; the infringement by any person of any Intellectual Property Rights of any third party caused by their use of Madgadgets or the Madgadgets dropship program or any Product purchased through Madgadgets; any loss or damage resulting from your use or the inability to use the Madgadgets web site or resulting from unauthorised access to, or alteration of your transmissions or data in circumstances which are beyond our control; any loss of profit, wasted expenditure, corruption or destruction of data or any other loss which does not directly result from something we have done wrong; any amount or kind of loss or damage due to viruses or other malicious software that may infect a user's computer equipment, software, data or other property caused by persons accessing, using or downloading Madgadgets, or from transmissions via emails or attachments received from Madgadgets or its dropship members; the availability, quality, content or nature of the other sites on the Internet that are owned and operated by third parties ("External Sites") to which Madgadgets link and web sites located on or through any External Site nor for any transactions involving External Sites (including as to 'cookies', personal data, confidential information, or purchases of domain names or other services). You should contact the site administrator or webmaster for those External Sites if you have any concerns regarding such links, web site or transactions; all representations, warranties, conditions and other terms which but for this notice would have effect.
D10. COPYRIGHT - The vast majority of material featured on this site is subject to copyright protection held by the product manufacturer, and as such is governed by the owners regulations. The copyright protected material owned by madgadgets.com may be reproduced free of charge in any format by any of our current dropship program members. The usage of such material, either Madgadgets or 3rd Party manufacturer, is to be managed and controlled by the dropship member, and once applied to any marketing material located away from this website, any implications or legal issues resulting from the 3rd party usage of this material or sale of our products is entirely at the dropship members risk. Any other proposed use of the material from this website is expressly forbidden.
By creating a 'Dropshipping Account' with Madgadgets you accept the Dropshipping terms of trade as above, and the 'RETAIL TERMS & CONDITIONS' where applicable.
